ATF Update: Registration and Tax Stamp Requirements Drop for SBRs and Suppressors

Major news for the NFA community: The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has issued an official Open Letter and FAQ outlining sweeping updates to National Firearms Act (NFA) enforcement.

This federal guidance stems from Congress's passage of the "One Big Beautiful Bill" act, which reduced making and transfer taxes to $0 for specific firearm categories.

If you are looking to buy, build, or transfer firearms, here is everything you need to know about what changed, what stayed the same, and how it impacts firearm enthusiasts.

1. What Changed? No More ATF Approval or Tax Stamps for SBRs & Suppressors

Under the newly released guidance, the ATF will not enforce prior approval or NFA registration requirements for making or transferring items where Congress eliminated the tax.

Covered Categories:

  • Short-Barreled Rifles (SBRs)

  • Short-Barreled Shotguns (SBSs)

  • Suppressors (Silencers)

  • Any Other Weapons (AOWs)

For these items, buyers and builders are no longer required to obtain prior ATF approval, pay for a tax stamp, or maintain NFA registry filings under federal enforcement. In practice, acquiring these items standardly relies on a Form 4473 and NICS background check through an FFL.

2. Machine Guns & Destructive Devices: No Changes

For followers of MyFullAuto.com, it is critical to note that full-auto machine guns are NOT covered under this policy shift.

What Remains In Effect:

  • The $200 Tax Stamp: The $200 tax remains fully active for all machine guns and destructive devices.

  • Full NFA Registration: You must still apply, receive ATF approval, and submit full NFA paperwork (including fingerprinting and photo requirements) prior to transferring or making a machine gun or destructive device.

  • Pre-1986 Machine Gun Registry: All existing federal restrictions under the Goldwater Amendment/Firearm Owners Protection Act (FOPA) of 1986 regarding transferable machine guns remain intact.

3. Important Fine Print: State Laws & Travel Rules

While federal enforcement for SBRs and suppressors has been relaxed, key caveats remain:

  1. State & Local Laws Still Apply: The ATF guidance does not override state or local restrictions. If your state bans short-barreled rifles, suppressors, or certain NFA items, state-level bans remain enforceable.

  2. Interstate Travel Rules: Short-barreled rifles and shotguns still carry travel rules under the Gun Control Act (GCA). Always check federal transport laws before crossing state lines.

Summary Checklist: ATF NFA Guidance at a Glance

  • Suppressors / Silencers: $0 tax stamp, no ATF pre-approval required (state restrictions still apply).

  • Short-Barreled Rifles (SBRs): $0 tax stamp, no ATF pre-approval required (state restrictions still apply).

  • Any Other Weapons (AOWs): $0 tax stamp, no ATF pre-approval required (state restrictions still apply).

  • Machine Guns: $200 tax stamp and full ATF pre-approval still required (state restrictions still apply).

  • Destructive Devices: $200 tax stamp and full ATF pre-approval still required (state restrictions still apply).

That was a clear and concise explanation of the updated ATF registration of SBRs and suppressors.
